• You must be at least 18 years of age to use this Platform.
• If you are under 18, you may use the Platform only under supervision and consent of a parent or legal guardian.
• By using the Platform, you represent and warrant that you have full legal capacity to enter into a binding agreement under applicable law.

Testhone is an independent online educational technology platform providing:

• Mock examinations and practice tests
• Simulated competitive exam environments
• Instant scoring and analytics
• Ranking systems and performance comparison tools
• Explanations and answer keys
• Practice-based assessment services

The Platform is not affiliated with, endorsed by, or associated with any government body, examination authority, or recruitment agency.

All tests are for practice and preparation purposes only.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain confidentiality of login credentials
• Immediately notify us of unauthorized access
• Accept full responsibility for all activities under your account

The Company reserves the right to suspend or terminate accounts that provide false information.

You may not create multiple accounts for unfair ranking advantage.

4.1 You agree NOT to:

• Use automated bots, scripts, or scraping tools
• Copy, record, distribute, or reproduce questions
• Share login credentials
• Attempt to reverse engineer the Platform
• Interfere with security features
• Use VPNs or technical manipulation to bypass restrictions

4.2 During mock exams:

• No use of unfair assistance tools
• No sharing of questions or solutions
• No screen recording or content capture
• No tab-switching if restricted by system
• No impersonation

The Company may invalidate scores, remove rankings, suspend accounts, or permanently ban users in case of misconduct.

All content including but not limited to questions, solutions, UI design, code, graphics, branding, logos, algorithms, and analytics models are the exclusive intellectual property of Testhone.

Unauthorized copying, reproduction, resale, redistribution, commercial use, or content scraping is strictly prohibited.

Violations may result in civil and criminal action under applicable intellectual property laws.

Certain services may require payment. All fees are non-refundable unless explicitly stated otherwise.

We reserve the right to modify pricing at any time, offer discounts at our discretion, and discontinue services without liability.

Payment gateway transactions are processed through third-party providers. We are not responsible for transaction failures caused by banks or payment processors.

In case of duplicate payment due to technical error, refund requests must be raised within 7 days.

Testhone does not guarantee:

• Selection in any government examination
• Improvement in score
• Rank accuracy beyond platform environment
• Similarity of questions to actual exams

Platform rankings are algorithmically generated simulations and are not official rankings. Reliance on Platform performance is at your own risk.

We do not guarantee uninterrupted or error-free operation. We are not liable for:

• Server downtime or internet connectivity issues
• Device incompatibility
• Data loss due to user negligence
• Exam interruption due to power failure or technical malfunction

We reserve the right to modify or suspend features temporarily for maintenance.

We collect and process:

• Name, email, contact information
• Device information and usage analytics
• Performance and exam data

Data is used for:

• Providing services, improving algorithms, and analytics
• Fraud detection and compliance with law

We do not sell personal data to third parties. We may disclose data if required by law, in response to lawful requests, or to protect rights, safety, or property.

While reasonable efforts are made to ensure accuracy, we do not warrant that all content is error-free. Questions, answers, or explanations may contain inadvertent mistakes.

Users are encouraged to verify critical information independently.

The Platform may contain third-party links. We are not responsible for third-party content, their privacy practices, or their services. Accessing third-party websites is at your own risk.

To the maximum extent permitted by law, Testhone shall not be liable for indirect damages, loss of opportunity, academic loss, emotional distress, data loss, revenue loss, or consequential damages.

Our total aggregate liability shall not exceed the amount paid by you (if any) in the preceding 3 months.

You agree to indemnify and hold harmless Testhone, its directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising out of:

• Your violation of these Terms
• Misuse of the Platform
• Violation of intellectual property rights
• Breach of law

We may suspend or terminate your account for violation of Terms, fraudulent activity, abusive behavior, or legal compliance reasons.

Termination does not waive our right to pursue legal remedies.

We are not liable for failure or delay caused by natural disasters, government restrictions, cyber-attacks, server outages, pandemic-related disruptions, or events beyond reasonable control.

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms. Users are encouraged to review Terms periodically.

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of courts located in Mumbai, Maharashtra.

Parties shall attempt to resolve disputes amicably within 30 days.

If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, conducted in Mumbai in the English language.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force.

These Terms constitute the entire agreement between the User and Testhone regarding use of the Platform.
